The 2018 Farm Bill – What Does It Mean For CBD And Hemp?
President Trump signed the 2018 Farm Bill today, which is a game-changing piece of legislation for a variety of businesses, including hemp.
Hemp (and, by extension, CBD) has been classified as a controlled substance for decades, alongside marijuana and other intoxicants. Hemp, on the other hand, will be supervised by the Department of Agriculture in the future.
The CBD industry, which had been operating in a legally murky area for decades, will be transformed as a result of this development.
With the 2014 Farm Bill, some requirements were loosened, but it was still difficult for CBD companies like ours to meet the rules, as several were nearly wholly open to interpretation.
With the 2018 Farm Bill, hemp farmers will be able to participate in USDA programs for certifications and competitive awards. When combined with a $350 million CBD business in 2017 (despite the rules), the sky is the limit for hemp!
The History of Hemp Prohibition
One of the first actions taken by the United States in combating hemp plants was the Marihuana Tax Act of 1937. However, attempts to stifle the hemp sector began as early as 1906, long before the bill was passed. Hemp was largely utilized to create paper at the time.
In 1969, the Tax Act of 1937 was overturned in the case of Leary v. the United States. After Timothy Leary was arrested for marijuana possession, the previously established tax act was deemed to be unlawful.
The Controlled Substances Act was passed the next year, which the new 2018 Farm Bill successfully overrides. The Marihuana Tax Act of 1937 was repealed, and hemp was designated as a controlled substance.
The 2018 Farm Bill’s Highlights

This should provide federally regulated institutions – banks, merchant services, credit card firms, e-commerce sites, and advertising platforms — confidence in transacting business with the hemp and hemp product industry.”

State and tribal governments may impose their own limits or regulations on hemp production and sale, but they cannot obstruct interstate transportation of hemp or hemp products.
We are confident that municipal and state officials will follow Congress’ lead, as well as the World Health Organization and the United States Food and Drug Administration (FDA) pronouncements and resolutions declaring CBD to be safe, non-toxic, and non-addictive after extensive scientific testing.
The FDA continues to have jurisdiction over the regulation of hemp products that are ingested and applied topically. We welcome the agency’s ongoing efforts to prosecute unscrupulous actors that destabilize the sector by making false marketing claims.

From Section to Section
Hemp is included in USDA’s supplemental and alternative crops programs under Section 7129 (p. 313). Hemp is included in USDA’s key agricultural materials programs under Section 7501 (p. 338).
Section 7605 (p. 347) directs the USDA Secretary to prepare a report on the 2014 Farm Bill pilot program, after which the program is repealed one year after the new permanent hemp program is established. The heart of the new permanent legalizing regime is Section 10113 (p. 429):
Hemp is defined as all elements of the plant that contain less than 0.3 percent THC, including “derivatives,” “extracts,” and “cannabinoids,” according to Section 297A (p. 429).
Section 297B (p. 429) gives states and tribes the authority to submit plans to the USDA for a permanent hemp-growing program. Information gathering, testing, and inspection procedures are all required.
Within 60 days, the USDA Secretary must approve or reject the plan, after consulting with the Attorney General. Where there is noncompliance, the Secretary can audit state programs and collaborate with the states to develop corrective action plans.
Section 297B(e)(p. 431): Requires states and Tribes to adopt processes for dealing with infractions, including corrective action in cases of negligence.
Individuals who commit drug offences are ineligible to participate in state or tribal growth programs for ten years after their conviction, according to Section 297B(e)(3)(B) (p. 432).
Participants in the 2014 Farm Bill pilot programs, on the other hand, are grandfathered into permanent programs despite any prior criminal conviction.
Section 297C (p. 432): States and Tribes must keep records on hemp-growing lands, as well as testing, enforcement, and inspection methods. The USDA Secretary must collect this data such that it is available to local, state, and federal law enforcement in real-time.
The USDA Secretary is obligated to provide a yearly report to Congress on the program’s implementation under Section 297D (p. 434).
Nothing in the new law alters the FDA’s power under the Food, Drug, and Cosmetic Act or the Public Health Service Act, according to Section 297D(c)(p. 434).
Section 10114 (p. 435): Nothing in the act prevents hemp from being traded across state lines, and States or Tribes cannot prohibit hemp or hemp products from being transported within their jurisdiction.
Title XI (p. 439): Hemp growers are now eligible for crop insurance, and the crop insurance program’s marketability standards can be disregarded.
Hemp is removed from the definition of “marihuana,” and THC found in hemp is excluded from the definition of a controlled substance.” Section 12619 (p. 540): Hemp is removed from the definition of “marihuana,” and THC found in hemp is excluded from the definition of a restricted substance.”
Michigan’s Cannabis Law Now In Effect – What’s Next?
Recreational marijuana became legal in Tasty Hemp Oil’s home state of Michigan today, December 6th. This is due to Proposition 1, which was approved by the voters in November.
What does the proposition include, and how will it affect our industry of non-intoxicating hemp products, now that such a significant change is coming to our state?
What Does The Michigan Proposition Change?
Adults aged 21 and over can now use marijuana recreationally starting today. Keep in mind that smoking in public is still prohibited. In public, you can have up to 2.5 ounces of the herb on you, but in a secure location, such as your house, you can have up to 10 ounces.
Growing will also be legal, with each home allowed to have up to 12 plants! As we said when Proposition 1 was originally enacted, this is not a joke, like most other states that have legalized marijuana only allows up to four plants per person.
What Impact Will This Have on CBD?
While the passage of this bill has no direct impact on CBD, it clearly sets a new benchmark at the state level. We at Tasty Hemp Oil hope that this will lead to greater testing and study into the many advantages of CBD, as well as an increase in public awareness about CBD.
The Michigan House of Representatives has adopted a bill that would designate hemp (from which CBD is derived) as an agricultural product rather than lumping it in with marijuana.
